GENERAL TERMS AND CONDITIONS
The following general conditions apply to and, are deemed to be incorporated in to all contracts for sale and supply of the company’s services and materials;
1. The placing of an order expresses acceptance of our terms and conditions of business.
2. These terms and conditions do not affect the customer’s statutory rights.
3. No Web Orders can be delivered / posted without full payment.
4. All prices shown include Value Added Tax (VAT) at the statutory rate current at the date of invoice. We reserve the right to express the price exclusive of VAT, but we shall show VAT separately and include it in the total price.
5. Where we charge separately for packing, carriage and insurance and other relevant charges, the appropriate rates are set out in our specified pricing structure shown elsewhere on the Website.
6. Our prices are reviewed periodically.
(a) The company reserves the right to alter prices and/or specifications.
(b) The customer has the right to accept or decline any changes as indicated by clause 6 (a).
7. No items for return can be accepted at the company’s offices without prior agreement.
8. Non receipt or complaints must be reported to the company within 10 working days in writing. This clause does not affect the customer’s statutory rights.
9. Our usual delivery shall be 48 hours for chemical & accessory stock items from date of order received from customer.
10. Gazebos are ordered in specially and are normally available for delivery within 3 weeks. (Exceptions may apply if circumstances beyond our control arise)
10a. Special Order spa covers can take up to 6 weeks.
10b. Coast / Softub / Rotospa deliveries will be discussed at the time of purchase. Stock spas will be delivered according to the work diary. Special order spas can take up to a maximum of 12 weeks to arrive from Canada. Shorter timescales are common in the summer months but cannot be promised.
11. A full refund will be made in the event of a delivery being delayed due to any circumstances which are attributable to the company and whereby no alternative date is acceptable to the customer. (Spas not included)
12. The company guarantees, that should our products not be to the standard, or in any way different from that advertised, we will refund any monies paid by the customer, but shall apply only to those item or items in question.
13. No property in or title to the goods shall pass from the company to the customer unless and until the customer has made full and complete payment to the company. Special Order spas cannot be refunded after the date of order, unless otherwise agreed. All Deposits are non-refundable unless previously agreed in writing.
14. The company does not accept responsibility for damage to any equipment in which our products are used for the purpose other than those for which it was designed.
15. Website Accessory goods – Delivery charge on orders under £100.00 will be charged at £9.95 and added to the total order at the checkout.
Orders over £100.00 are delivered free of charge within England, Scotland & Wales.
16. If any cause outside the seller’s control, or any unforeseen contingency renders it impracticable for the seller to execute any order or delivery, the seller reserves the right to cancel the order and to repay any deposit payment received.
Spa Warranties (Spas are not available to purchase online, see in store for Spa sales):
a) All manufacturers’ equipment and apparatus installed as provided for in this contract shall carry the full warranties of Softub, Rotospa or Coast Spas, supported by the limited warranties on the manufacturer.
b) Warranties are effective only if the buyer has complied with all the terms and conditions, payments and provisions of the contract. The buyer must follow all of the manufacturer’s written instructions to ensure performance of the manufacturer’s written warranty,
c) Hot tubs At Home guarantees to repair or replace under issued warranties any products or parts found defective in materials or workmanship under terms of the manufacturer’s warranties. d) Relocation of the spa, unless approved or conducted by Hot tubs At Home, will void any warranty.
Delivery charge on orders under £100.00 will be charged at £9.95 and added to the total order at the checkout. Orders over £100.00 are delivered free of charge within England, Scotland & Wales.
From receipt of confirmed order, dispatch of chemicals & accessories will be approximately 48 hours for stock items, if for any reason we do not hold the item in stock our orders manager will contact you to advise you of the expected delivery time. All goods are fully insured whilst in transit.
Hot tubs At Home reserve the right not to dispatch goods until payment has been made in full. Unfortunately we do not take orders for export outside of the UK at present.
Return of damaged, faulty or wrongly ordered goods:
In the unlikely event that your order arrives damaged, please notify us immediately so that we can arrange for your faulty goods to be returned and immediately dispatch a new consignment at no additional cost to you. If you do not want the faulty goods replaced then we will arrange the return of the goods and issue you a full refund.
Should we inadvertently dispatch the wrong goods, please notify us immediately so that we may rectify the problem, at no additional cost to you. We will collect the wrongly sent goods and we will either send the correct goods or give you a full refund.
If you inadvertently order the wrong products and do not realise until delivered. Please notify us and we will arrange to collect and deliver the correct products. We will obviously need to charge carriage in this case. We will be happy to quote should this situation arise. These terms do not affect your statutory rights as a consumer.
Applicable to Website Orders Only – Under the Consumer Contracts (Information, cancellation and Additional Charges) Regulations 2013, you have a right to cancel within 14 days of receiving your goods. To arrange cancellation, please download and complete our cancellation form and return the completed form to us within 14 days of purchase, with proof of your order.
4.4 The rights to return the goods to us will not apply in the following circumstances: –
-In the event that the product has been used
-In the case of software, audio or visual products, where the packaging has been unsealed -To any products that we have made or customised specifically for you
The provisions of this clause 4.4 do not affect your statutory rights.

We trust that you will not have reason to complain about our products and services but if you do, please contact us and we shall endeavor to process your complaint quickly and effectively.

HOW TO SHOP ONLINE EFFECTIVELY:
You can order any of our products online, with the exception of Coast Spas, Softubs, Pools and Gazebos using our secure shopping facilities. Using the links that appear at the right of the screen, simply select a product range, and then choose an item from the list by clicking the image.
You will then see a screen where you can enter the desired quantity of product, after which you simply click on the ‘Buy Now’ buttons and the item will be added to your shopping basket. When you have completed, simply click ‘Checkout’ to process the order. For a full list of items that you have ordered you can click on the link ‘Basket’ at any time and here you can also choose to remove any of the items from your order, then proceed with your order by filling in all of the relevant details at the checkout, making sure you include your credit/debit card information along with your name and address.
A valid email address must be entered, as you will be emailed your confirmation and order number, which must be quoted in any correspondence.
Only, once you click the ‘Place Order’ button will your order be placed with us.
10.1 While we endeavor to ensure that the information on our Website is correct, we do not warrant the accuracy and completeness of the material on this Website. We may make changes to the material on our Website, or to the products and prices described in it, at any time without notice. The material on this Website may be out of date, and we make no commitment to update such material.

We will not e-mail you in the future unless you have given us your consent and we will give you the chance to refuse any marketing e- mail from us or from another trader in the future.

You can be sure, because your credit card security is our highest priority. In fact, our shopping system is so safe that in the highly unlikely event of credit card fraud, we will reimburse the first £20 of your loss. Since, legally, the credit card issuer must repay the rest, no matter what happens, you will not be held responsible for any fraudulent credit card charges.

Hot tubs At Home are situated at The Bell Plantation Garden Centre, Watling Street (A5), Towcester, Northamptonshire. NN12 6GX. Within these premises purchasers can view Coast Spas, Gazebos, Chemicals & Accessories and Decking platforms. With 16 models on display and 3 models working, a FREE wet test can be arranged at any time. A dedicated changing room is available for use, which is private. We always have between 2 and 3 spas running for you to try.
